The Rooms To Go Background Check class action settlement includes “all persons as to whom RTG (including its affiliates) procured a background check, including a consumer report, in conjunction with an application for employment, promotion, or job change within the Class Period of August 16, 2019 through August 31, 2019.”

In August 2017, plaintiff Charlotte Bulgajewski filed this class action lawsuit against Rooms To Go alleging violations of the Fair Credit Reporting Act.
Rooms to Go is an American furniture store chain, based in Seffner, Florida. The company operates 226 stores in Alabama, Florida, Georgia, Louisiana, Mississippi, North Carolina, South Carolina, Tennessee, Texas, Virginia, and Puerto Rico.
Specifically the complaint alleges that Rooms To Go procured background checks on job applicants using a disclosure form not in compliance with the FCRA, and therefore not properly authorized.
The FCRA requires companies to disclose to its job applicants (and employees) that it may obtain a consumer report on them for employment purposes, prior to obtaining a copy of their consumer report. This disclosure must stand alone, meaning that no other information can be on the form.

In the past year, a slew of FCRA class action lawsuits have been settled, including a $850K settlement with Area Wide Protective. a $325K settlement with Umpqua Bank and a $1.2 million settlement with PetCo. Another background check class action lawsuit against PepsiCo was settled for just under $2 million.
Class members who wish to object to or exclude themselves from the Rooms To Go Background Check settlement must do so by August 8, 2019. Class members who wish to receive payment must submit a Claim Form on or before February 27,2019.
