The Tesla Enhanced Autopilot class action settlement includes “all U.S. residents who purchased Enhanced Autopilot in connection with their purchase or lease of a Tesla Hardware 2 Model S or Model X vehicle delivered to them on or before August 30, 2019.”

Your payment amount will depend on factors including:
- Tesla’s representations regarding Enhanced Autopilot at the time you purchased or leased your vehicle
- The timing and content of Tesla’s releases of Enhanced Autopilot software upgrades; and
- The total number of months up to and including August 30, 2019 during which you were in possession of your vehicle.
Proof of Purchase
- Class members will automatically receive a settlement payout unless they choose to exclude themselves from the Tesal Enhanced Autopilot settlement.

In April 2017, plaintiffs Dean Skeikh, John Kelner, and Tom Milone filed this class action lawsuit against Tesla alleging that that company failed to deliver as promised on its 2016-2017 Model S Enhanced Autopilot features.
The lawsuit alleges, among other things, that Tesla did not release Enhanced Autopilot features with capabilities that corresponded to the schedule it had previously indicated to its customers. Specifically, Tesla initially promised that the Enhanced Autopilot software was “expected to complete validation and be rolled out to your car via an over-the-air update in December 2016, subject to regulatory approval”.
However, it missed this delivery date and then changed its website to state: “Tesla’s Enhanced Autopilot software has begun rolling out and features will continue to be introduced as validation is completed,” leaving the impression that only “validation” and “regulatory approval” were needed. But, according to the plaintiffs, what Tesla has delivered to date does not resemble what it promised and resulted in economic injury to vehicle owners.
While Tesla acknowledges that it took longer than it initially expected to roll out the Enhanced Autopilot features, the company denies any claim of wrongful conduct.

Class members who wish to object to or exclude themselves from the Tesla Autopilot settlement must do so by August 6, 2019. Class members who wish to participate in the settlement do not need to do anything.
